Terms of Service

1. Your Account

• Account Creation: To use most features of Numblie, you must create an account. You agree to provide accurate and complete information when you sign up. You are responsible for all activity that occurs under your account.
• Usernames: When you create a username, you agree not to use any language that is offensive, impersonates someone else, or violates any person's rights. As noted in our Privacy Policy, your username is public on the global leaderboard. We strongly advise against using your real name or any personal information in your username.
• Account Security: You are responsible for keeping your password safe and confidential. Notify us immediately if you suspect any unauthorized use of your account.

2. Code of Conduct

You agree to use our Services only for their intended purpose and in compliance with all applicable laws. You agree not to:

• Use cheats, exploits, bots, or any other unauthorized third-party software to modify or interfere with the Services.
• Attempt to gain unauthorized access to our Services, servers, or other user accounts.
• Engage in any activity that is fraudulent, abusive, defamatory, harassing, or that disrupts or harms the experience of other users. This includes the selection of inappropriate usernames.
• Reverse engineer, decompile, or attempt to extract the source code of our app.

3. Enforcement and User Reporting

• Enforcement: We reserve the right to investigate and take appropriate action against anyone who, in our sole discretion, violates these Terms. This may include removing offending content (like usernames), suspending your access to the Services, or permanently terminating your account without notice.
• User Reporting: If you see any behavior or content that violates these Terms, please report it to us for review by contacting us at the email provided in the "Contact Us" section.

4. Children and Parental Consent

Our Services are not intended for use by children under the age of 13 without parental consent.

• For Users Under 13: If you are under 13, you must have permission from your parent or legal guardian to use our Services. By using the Services, you confirm that you have this permission.
• A Note to Parents and Guardians: By granting your child permission to use our Services, you agree to these Terms on their behalf. You are responsible for monitoring your child's use of the Services. You can delete your child's account at any time directly through the account settings in the app.

5. Advertising

To support our Services, we may display rewarded advertisements from our partner, Google AdMob.

• Optional Ads: These ads are entirely optional. You may choose to watch them to earn in-game rewards.
• Non-Personalized Ads: As stated in our Privacy Policy, we have configured our ad settings to be non-personalized. This means the ads you see are based on the context of the app, not on your personal data.

6. In-App Purchases

Our Services may offer virtual items or other features for purchase ("In-App Purchases").

• Payments: All payments are processed through the app store from which you downloaded the application (e.g., Apple App Store or Google Play Store) and are subject to their respective terms and conditions.
• No Refunds: To the fullest extent permitted by law, all In-App Purchases are final and non-refundable.

7. Intellectual Property

All content and materials in our Services, including the Numblie name, logo, graphics, game design, and software, are the exclusive property of Numblie or its licensors. You are granted a limited, non-exclusive, non-transferable license to access and use the Services for your personal, non-commercial use. You may not copy, modify, distribute, or create derivative works from our content without our express written permission.

8. Intellectual Property Complaints

If you believe that any content on our Services infringes your copyright, please send a notice to our support email with the following information:

• A description of the copyrighted work that you claim has been infringed.
• Information reasonably sufficient to permit us to locate the material.
• Your contact information, including your address, telephone number, and email.
• A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
• A statement that the information in the notification is accurate, and, under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

9. Account Deletion

You have the right to terminate your account at any time. You can delete your account and all associated data directly from the account settings menu within the app. This action is permanent and cannot be undone.

10. Modification and Termination of Services

We reserve the right to modify, suspend, or discontinue the Services, or any part thereof, at any time and for any reason, with or without notice. You agree that we will not be liable to you or any third party for any modification, suspension, or discontinuation of the Services.

11. Disclaimers and Limitation of Liability

• "As Is" Service: Our Services are provided "as is" and "as available" without any warranties of any kind, express or implied. We do not guarantee that the Services will always be secure, error-free, or uninterrupted.
• Limitation of Liability: To the fullest extent permitted by law, Numblie shall not be liable for any indirect, incidental, special, or consequential damages arising out of or in connection with your use of the Services.

12. Indemnification

You agree to indemnify, defend, and hold harmless Numblie and its affiliates from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from your use of the Services, your violation of these Terms, or your violation of any rights of another person or entity.

13. Changes to These Terms

We may update these Terms from time to time. We will notify you of any significant changes by posting the new Terms in the app or by other means. Your continued use of the Services after such changes constitutes your acceptance of the new Terms. The "Last Updated" date at the top of this page will always indicate the latest version.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of South Africa, without regard to its conflict of law principles.

15. Dispute Resolution

We encourage you to contact us first if you have an issue, as most disputes can be resolved informally. If we cannot resolve a dispute, you agree that it will be resolved by binding arbitration. The arbitration will be conducted in Johannesburg, South Africa, by a single arbitrator under the rules of a recognized arbitration authority in South Africa. This does not prevent you from bringing issues to the attention of federal, state, or local agencies.
